The Monroe County District Attorney’s Office must now decide if will accept a judge’s ruling that overturned a 15-year-old murder conviction…seek a new trial…or just allow Jose Torres of Rochester to go free.
A judge’s ruling this week overturned his conviction in the 2001 murder of Miguel Cruz after a new witness gave evidence that contradicted the confession Torres gave to police.
Another man already in prison for murder testified that he was the one who killed Miguel Cruz. Angel Carasquillo testified at a hearing earlier this year.
Torres has long said his confession was coerced. Prosecutors have said they still believe Torres was the killer. They have no comment so far on the new ruling.
